Worth keeping or should i just get a refund

Recently bought a sealed Ogre battle 64 for 100$. Was supposed to be good shape with only some pinch-in but arrived with some crushing on one side, a small tear, and one of the corners is poking through the seal as well. Overall it isn't bad but it's definitely not as advertised.

The tear on the side isn't an actual tear, more like where the seal has slightly busted apart. The corner is poking through though.
I only collect 100% perfect sealed copies ... so in my opinion get a refund!
Yea, im not extremely picky, but the one corner is poking through and has wear so that's sort of a deal breaker.

I contacted the seller and he responded and said it probably happened during shipping(which is possible because it seems like it had room to slide around). Oy vei, he/she seems okay though so shouldn't be too hard to get this resolved.
