Bad listing misrepresentation

Hmmm...with a title like First Version and Original...you'd think it was not the ugly Players Choice Version, but alas, they all are. I've asked the seller repeatedly to change the title because it throws of the search for a true orig release all the time but the guy's an a-hole and says "Yes it is yellow Players Choice, yes, the title is accurate."

netural is the same as negative now. they both count against your rating.

It does say "brand new" condition. People don't expect brand new games to be cracked, etc.

I can second that! I had the same problem!

I sort of hate the Shadow Of The Colossus (wrong?) "Collectors edition", "limited edition",cum on, all SOTC PAL are in that digipack.

Yeah, unfortunately, eBay is not for collectors. It never was, but once upon a time you could find other collectors using it.

It would be nice if there was a better alternative. However, we're all stuck using it for now.

You pretty much have to go with the most liberal possible meaning of the main description, ignore the title and all other search parameters else (check out how many Japanese games proclaim to have an ESRB rating), and hope for the best.

Personally, I instantly dismiss any auction that:
* Has a contradiction between the title, search data, image(s) or description
* Shows a stock photo (these have caused me the most trouble)

Ironically, feedback is relatively unimportant.

If I can't afford to miss out, I will contact the seller for clarification instead.

It's unfortunate that this is what is required, but it's just a fact of using eBay these days. eBay won't help either to clarify or even enforce what other sellers are saying, so you've got to do it yourself.

Once upon a time, it would have been a great idea to start some sort of register of "good" eBay sellers, but most non-new-release Factory Sealed games on eBay these days are one-offs, so there isn't a lot of point.

In regards to that auction, I would not have purchased anything without seeing an actual picture of the item first. I am always suspicious of people who list something with just a stock picture, and ESPECIALLY those who state "All sales are final" in their listing, as it usually means they want to get shot of it and are often hiding something.

Technically, the seller didn't misrepresent the item. They said it was "Brand new and factory sealed", which it is both "Brand new" (As in never used) and "Factory sealed" (As in still wrapped in the cellophane that it left the factory packaged in). But, I do think it was unethical to list the game without being fully honest about the condition of the game, and also not including an actual picture which would've made it easy to spot the damage.

Unfortunately, there is a lot of this sort of thing happening on eBay at the moment, and I have been stung quite a few times lately even though I take precautions. There are always a few that will lie to you all along just to get rid of what they are selling. I would personally never dream about misleading anyone, and always try and be as honest as possible. If a game I am selling has a damaged case or torn cellophane, I say so (Eg, Kingdom Hearts II x2 I have for sale)
